In Federal Court in Pensacola, Florida, a judge denied 3M’s Motion to Dismiss the case against a number of service-members who suffered hearing damage as a result of defective combat earplugs sold to the military. 3M argued that they were following mandates dictated by the Department of Defense, and that the design was required by the U.S. Army. Judge M. Casey Rodgers found that no reasonable jury could conclude that the Army made the company do anything or dictated the specifics of the design.
